This Privacy Policy describes how Incoperation LLC ("Incoperation", "we", "us" or "our"), a Wyoming-incorporated limited liability company, collects, uses, discloses and protects personal information when you visit our website, contact us, or engage us for services.
1. Introduction
We respect your privacy and are committed to handling personal data responsibly and in compliance with applicable law, including the EU General Data Protection Regulation (GDPR), the UK GDPR, the California Consumer Privacy Act (CCPA/CPRA), the Australian Privacy Act, and the Personal Information Protection and Electronic Documents Act (PIPEDA) of Canada.
2. Data we collect
We collect personal information in three ways:
- Directly from you — when you submit a contact form, email us, or sign up to receive a quote (name, email, company, phone, brief of needs).
- Automatically — through cookies and analytics technologies (IP address, browser type, pages viewed, referring URL, device identifiers).
- From service engagements — when we operate ad accounts on your behalf, we receive access to your performance data and any data your platforms expose to us.
3. How we use your information
- Respond to enquiries, deliver quotes, and provide our services.
- Operate and improve our website and marketing materials.
- Comply with legal obligations, including tax and accounting.
- Send service-related communications (no marketing emails without consent).
- Detect, prevent, and address fraud or abuse.
4. Sharing & sub-processors
We share personal data only with trusted sub-processors who help us operate, and only to the extent strictly necessary. Current categories include cloud hosting and email infrastructure (Google Workspace, AWS), analytics (Google Analytics 4 with IP anonymisation), US-based accounting and tax providers, and payment processors for invoicing (Stripe). We do not transfer personal data to third parties for their own commercial purposes.
5. Your rights
Depending on your jurisdiction, you may have rights to access, correct, delete, port, or restrict processing of your personal data, withdraw consent, and lodge a complaint with your supervisory authority. Email info@incoperation.com to exercise these rights. We respond within 30 days.
6. Security
We maintain administrative, technical, and physical safeguards — encryption in transit (TLS 1.2+), least-privilege access, MFA on all internal tools, regular access reviews. No system is perfectly secure; we do not warrant absolute security.
7. Children
Our services are B2B and not directed at individuals under 16. We do not knowingly collect personal data from children.
8. Updates
We may update this Policy. Material changes will be reflected with an updated date at the top. Continued use after changes constitutes acceptance.

Terms of Service
These Terms of Service govern your use of the Incoperation LLC website and any services delivered under a separately executed engagement agreement.
1. Acceptance
You confirm you are at least 18 and authorised to enter binding agreements. If you don't agree, don't use the site or engage us.
2. Services
We provide performance marketing services including Meta Ads management, Google Ads management, creative production, landing-page & CRO, and full-funnel growth retainers. The specific scope is described in a separately executed Statement of Work (SOW) or proposal.
3. Fees & payment
- All fees stated in US Dollars unless otherwise specified.
- Retainer fees invoiced monthly in advance, due within 7 days.
- Project fees invoiced 50% on signing, 50% on delivery unless otherwise agreed.
- Late invoices accrue interest at 1.5%/month or the max permitted by law.
- You are responsible for media spend paid directly to platforms (Meta, Google, etc.). Incoperation does not finance media spend.
4. Term & termination
Retainer engagements include a 90-day initial term, then month-to-month with 30 days' written notice required for termination. Either party may terminate for material uncured breach with 15 days' notice. Project work may be terminated at any time; fees for work completed remain due.
5. Confidentiality
Each party agrees to keep the other's non-public business information confidential and use it only for the engagement. Confidentiality survives termination for three (3) years.
6. Intellectual property
All work product, creative assets, copy, and landing-page code produced specifically for you transfer to you on final payment. Incoperation retains ownership of underlying frameworks, templates, internal tools, and pre-existing know-how, plus a non-exclusive licence to reference engagements anonymised in marketing.
7. Warranties & disclaimers
We warrant that Services will be performed professionally and consistent with industry standards. WE DO NOT WARRANT OR GUARANTEE SPECIFIC PERFORMANCE OUTCOMES, including ROAS, CPA, conversion rate, or revenue. Marketing performance depends on many factors outside our control. Otherwise Services are "AS IS" and we disclaim all other warranties to the maximum extent permitted by law.
8. Limitation of liability
To the maximum extent permitted by law, Incoperation's aggregate liability shall not exceed fees paid by you to Incoperation in the three (3) months preceding the event giving rise to the claim. In no event shall we be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits.
9. Governing law & disputes
These Terms are governed by the laws of the State of Wyoming, USA. Disputes resolved exclusively in state or federal courts located in Sheridan County, Wyoming.
10. Miscellaneous
These Terms with any SOW constitute the entire agreement. No waiver is effective unless written. If any provision is unenforceable, the remainder remains in force.
Cookie Policy
1. What cookies are
Cookies are small text files placed on your device when you visit a website. Widely used to make sites work, improve UX, and provide aggregated analytics to site owners.
2. How we use cookies
We use cookies sparingly. Primary uses: (i) keep the site functional, (ii) measure aggregate traffic patterns, (iii) measure effectiveness of our own marketing on our own site. We do not build cross-site behavioural profiles or sell data.
3. Cookies we set
- Strictly necessary — required for navigation and security. Cannot be disabled.
- Performance & analytics — Google Analytics 4 with IP anonymisation.
- Functional — remember preferences such as theme or language.
- Marketing measurement — measure whether our own ads brought you here (Meta Pixel, Google Ads tag). No retargeting outside our own brand.
4. Third-party cookies
Some cookies are set by third parties operating with our permission (Google, Meta). These are bound by their own privacy policies — review them at the providers' websites.

Refund Policy
1. Our philosophy
We don't believe in performance guarantees we cannot underwrite — neither should any reputable agency. What we guarantee is process, cadence, and deliverables. If we fail to deliver what is contractually owed, we make it right.
2. Retainer refunds
Monthly retainer fees are non-refundable once the calendar month has begun (fixed delivery is allocated in advance). However:
- If we materially fail to deliver contractually agreed scope, you may request a pro-rata credit against the following invoice.
- The 90-day initial term may be terminated for material uncured breach with 15 days' written notice; any prepaid fees beyond that window are refunded.
3. Project refunds
- Before kick-off: full refund minus 10% mobilisation fee.
- After kick-off, before first deliverable: 50% refund.
- After first deliverable: no refund; fees due in full.
4. Audit credit
The standalone account audit ($499) is fully credited against your first month's retainer if you sign within 60 days of receiving the report.
5. Media spend is never refundable
Media spend paid directly to advertising platforms is not paid to or held by Incoperation, and is governed by the platforms' own refund policies. We have no authority to refund media spend on your behalf.
6. How to request
Email info@incoperation.com with subject "Refund request" and a brief description. We respond within 5 business days. Approved refunds are issued via the original payment method within 10 business days.
